OpenAI backs Senate bills to cement U.S. AI policy

OpenAI just threw its weight behind three U.S. Senate bills, notably supporting the Future of AI Innovation Act to formally authorize the U.S. AI Safety Institute. The company is actively courting lawmakers ahead of upcoming regulatory scrutiny to secure a front-row seat at the policy table.

Big tech usually treats Washington regulators like an uninvited guest at a house party, doing whatever it takes to slip out the back door.

OpenAI is taking the opposite approach, walking right up to lawmakers and asking where to hang the coats.

On Tuesday, OpenAI officially endorsed three Senate bills aimed at shaping federal artificial intelligence policy, throwing its heavyweight status behind Washington's regulatory push.

Three bills get the green light

The most consequential piece of legislation on the list is the Future of AI Innovation Act.

This bill would formally authorize the U.S. AI Safety Institute as a federal body, giving it legal teeth to develop standards, benchmarks, and deployment guidelines for frontier AI systems alongside public and private groups.

The act also instructs federal agencies to build curated datasets for public use, focusing on high-value data that commercial companies have little financial incentive to produce.

The other two bills, the NSF AI Education Act and the CREATE AI Act, target the talent pipeline.

They propose federal scholarships for AI research and fund educational resources across universities and K-12 classrooms.

Anna Makanju, OpenAI’s vice president of global affairs, publicly backed the moves, emphasizing that the institute plays a vital role in keeping frontier models safe.

Playing nice before the gavel drops

The timing of OpenAI's announcement was anything but random.

Two of the endorsed bills are scheduled for consideration in a Senate Executive Session on Wednesday morning, making Tuesday's endorsement a targeted push.

OpenAI also joined a broader coalition on Monday, signing a joint letter to lawmakers alongside Microsoft, Meta, Amazon, Palantir, and Cohere to back the institute.

Now sitting on an $86 billion valuation and powering deals with Microsoft and Apple, OpenAI knows regulatory scrutiny is inevitable.

Endorsing these bills helps the company bank goodwill on Capitol Hill before harsher antitrust or copyright battles arrive.

More importantly, working hand-in-hand with the AI Safety Institute ensures OpenAI keeps a prime seat at the table when the final rules get written.

Why it matters

For students, researchers, and early-stage builders, federal scholarships and public datasets could lower the barrier to entry against deep-pocketed tech giants.

For the AI ecosystem, cementing the AI Safety Institute in federal law marks the end of the unregulated wild west. Standardized evaluations and safety benchmarks will soon become an operational requirement for everyone pushing frontier models.

We think OpenAI's playbook here is exceptionally clever. Instead of fighting regulation, it is actively volunteering to help write the playbook, framing itself as a cooperative steward of safe technology.

The quiet risk, however, is regulatory capture. When existing giants help define what safe AI looks like, the compliance burdens often end up being easy for trillion-dollar incumbents to swallow, but lethal for upstart challengers.
